That wasn't banned - VW would never have sanctioned that for proper advertising purposes

A lot of stuff like that is done by the manufacturers to send out as viral emails, but that was a step too far for it to be that. But it was well done

Preferred the spoof of the dancing Citroen C4 using a 2CV - and when it came back down it fell apart

VW sued the creator of that video, which I think is harsh. He wasn't really slandering VW was he!

Clearly not, as slander is verbal deformation of character.

They were, however, libelling VW as the advert was likely to reduce people's opinion of the brand (in that they'd allow such tasteless advertising).

Did VW win? I guess they flexed some corporate muscle and did......however, it could also be argued that the spoof may have enhanced the brand; after all, wouldn't you want your nearest and dearest inside a Polo during an RTA if it could withstand that blast unscathed?

I think you'll find it's - Defamation

Defamation is an injury to the reputation or character of someone resulting from the false statements or actions of another. Defamation is a false attack on your good name. Your good name is regarded as a proprietary interest, not a personal interest. Defamation is an improper and unlawful attack against your proprietary right to your good name, your reputation.

Well, it's not really wrong, unless you like getting bogged down in semantics. It comes down to the distinction between what is verbal and what isn't. Slander is in fact the spoken word as opposed to verbal, which is why something said verbally on the radio or on television is libel rather than slander.

As an aside another distinction is that slander is normally only actionable upon proof of damages, unlike libel where damage is presumed. Hence it might be more sensible to say to someone's face that they are a twit that write it on a forum. For other reasons though it may be more sensible to write it on a forum instead.

Surely there is no distinction between the spoken word and words delivered verbally - my understanding was that libel applied to that which was recorded or broadcast, whereas slander was personal (if you see what I mean).

I do see what you mean and I understood entirely what you were trying to say. I would be the first to admit that I am, how do you say... picking of ze nits

The point is both libel and slander can be verbal (as opposed to written) but slander has to be the spoken word. As I say it is tiny distinction between understanding "verbal" as being contrary to non-verbal, ie. written and "spoken" as being contrary to unspoken, whether verbal or written. But on such distinctions some saddoes make their careers

Similarly there is a difference between the terms "verbal" and "words delivered verbally" (the latter, I agree, being more clearly synonymous with the spoken word - but the former less so).

Now if you had said words delivered verbally and personally rather than "verbal" I'd have kept my trap shut. And wouldn't the world have been a happier place for that

On a random tangent what do you reckon an offensive hand gesture or signing abuse to a deaf person would qualify as?
